Please find below Constitutional amendments received and discussed by Man Comm at the April meeting at which it was agreed to submit them to the AGM for consideration.

Article 7 could be read to mean that the President, Secretary & Treasurer cannot be delegates.
In particular, under 13.2, the Secretary & Treasurer have no vote.

7. COUNCIL
The governing body of the League shall be called the Council and shall consist of the League President, the Secretary, the Treasurer and one delegate from each Full Member of the League.
These ex-officio members of the Council may also, if eligible, be the delegate for their club (if a Full Member).
RULES for LEAGUE COMPETITIONS

The rules on defaults needs to be overhauled:

4.2 If 50% or more two or more players of a side is prevented from attending a match by some unforeseeable event the Management Committee may, at their its discretion, rule that the defaults so incurred be excluded from the total for the purpose of this clause.
4.3 No dispensation will be permitted under Rule 4.2 unless the team captain (or Club Secretary): (a) notifies the opposing team captain (or Club Secretary) and League Controller as soon as practically possible and, (b) submits a detailed written claim to the League Controller within 7 days of the match, who will then forward the claim to the Management Committee.

6. Promotion and , Relegation & Division Championships

7 CONSTITUTION OF TEAMS
7.1 Teams in the first division will consist of 8 players (alternatively, 6 players)
7.2 Teams in the 2nd division will consist of 6 players.
7.3 Teams in any remaining divisions will consist of 4 players.

Article 9 can be written more clearly and concisely. The new Article 9.3 states responsibilties
which are already implicit in Art 10.

9. REGISTRATION OF PLAYERS
Registration is only required for players who are not published in the most recent copy of the grading list. Clubs must provide full details to the league controller of all new players or players returning after a period of inactivity. Full details means full name, including middle initials, and date of birth if under 21. It should be indicated if the player has a current grading from another country of from FIDE. A returning player is one who previously played competitive chess in Scotland and may have a previous grade or a Chess Scotland player number. Registration of a returning player should provide an estimation of when the player was previously active and for which club. A match result will not be officially recorded for a team unless they have complied with supplying information on new or returning players.
9.1 Full details (including full name, and DoB if aged under 21) for any player not listed in the current CS grading list must be lodged with the League Controller when match results are submitted. If available, the player’s FIDE, ECF etc., grade must be provided. For players returning to chess, the player’s former grade and club (with dates) must be provided.
9.2 Failure to register such players will be treated as a failure to submit the match results.
9.3 If a player’s playing strength is unknown, clubs may be held to be negligent if they grossly over-estimate the player’s strength for the purposes of drawing up team lists.

Penalties under Art 10 are not severe enough, nor do they explicitly state that the opposing team can obtain redress.

10. PENALTIES
For a breach of Rules 8 and/or 9 the offending team shall incur a penalty up to and including forfeiture of the match.
10.1 Any blatant infringement of Rules 8 and/or9 shall be considered by the Management Committee and may incur penalties extending as far as the loss of two match points.
10.2 Where a team has been penalized under Clause 10.1, the Management Committee shall also determine the match result.

2. TEAM DECLARATION AND PLAYING ORDER
2.1 The match captains (or their deputies) of opposing teams shall, five minutes before the commencement of the match, exchange lists of their players in descending order of playing strength.
2.2 Except for the provision laid down in Clause 4 (below), no rearrangement of playing order is permitted after team lists have been exchanged.
2.3 Any blatant infringement of this rule concerning order of playing strength shall be considered by the Management Committee and may incur penalties extending as far as the loss of two match points.
2.4 Where a team has been penalized under Clause 2.3, the Management Committee shall also determine the match result.

6.5 If no agreement can be reached, games concluded in Quickplay finishes under Appendix D of the Laws of Chess should be sent to the Division Controller accompanied by a £20.00 fee per team per position. The fee will be returned to the successful claimant.
6.5 In the event of a dispute, the procedures described below must be followed.

DISPUTES PROCEEDURE
(N.B. See Rules of Play 6.5) this is to be deleted!
1 In the first instance, clubs should endeavour to resolve their disputes by negotiation between their nominated representatives and the Division Controller.
2 Failing agreement, each club must within 21 days of the dispute arising refer the dispute in writing to the Division Controller. The respective club secretaries will be notified by letter of the date when the dispute will be heard by a panel of the Management Committee.
3 The panel may invite clubs to:
3.1 Present their case by written submission and/or
3.2 Arrange for persons to appear before the panel to speak on matters relevant to the dispute.
3.3 4. The clubs involved will be notified in writing of the decision of the Management Committee.
5. A fee of £20.00 fee per team per position is applicable for disputed draw claims relating to the Quick-play “two-minute rule”. The Management Committee may, at its discretion, levy a fee on one or both parties in any other dispute. Where levied, the fee will be returned to the successful claimant.

QUICKPLAY RULES
A game with a quickplay finish is NOT the same as a Blitz or Rapidplay game, and certain rules are designed to prevent a player from winning on time when the position on the board does not justify it.
1 A 'quickplay finish' is the last phase of a game, when all the remaining moves must be made in a limited time.
2. A player may claim a draw when he has less than two minutes left on his clock and before his flag falls. This concludes the game. He may claim on the basis
(a) that his opponent cannot win by normal means, or
(b)
that his opponent has been making no effort to win by normal means.
In (a) the player
must write down the final position and his opponent verify it.
In (b) the player must write down the final position and submit an
up-to-date scoresheet which must be completed before play has ceased.
The opponent shall verify both the scoresheet and the final position.
The team captains
shall attempt to agree the outcome of the game.
Failing agreement, the claim shall be referred to the League whose decision shall be final.
Failing agreement, the claim shall be referred, by both clubs, to the League whose decision shall be final (see “Disputes Procedure”). In addition to the usual details, the following information must be provided: (a) clock times, (b) whether White or Black has the move.
3. Illegal moves do not necessarily lose. After the action taken under (FIDE) Article 7.4, for a first illegal move by a player the arbiter shall give two minutes extra time to his opponent; for a second illegal move by the same player the arbiter shall give another two minutes extra time to his opponent; for a third illegal move by the same player, the arbiter shall declare the game lost by the player who played incorrectly.
4 3. If both flags have fallen and it is impossible to establish which flag fell first the game is drawn.
Simplification of RapidPlay rules so that they read practically the same as the FIDE rules, as follows – to save space, the current GCL version is not shown.

RAPIDPLAY RULES
B1. A 'rapidplay game' is one where all the moves must be made in a fixed time between 15 to 60 minutes.
B2. The FIDE Laws of Chess (for normal chess) shall govern play, except where they are overridden by the following FIDE Laws for Rapidplay games and any local rules enacted by the League.
B3. Players do not need to record the moves.
B4. Once each player has made three moves, no claim can be made regarding incorrect piece placement, orientation of the chessboard or clock setting.
In case of reverse king and queen placement castling with this king is not allowed.
B5. The arbiter shall make a ruling according to FIDE Article 4 (The act of moving pieces) only if requested to do so by one or both players.
B6. An illegal move is completed once the opponent`s clock has been started. The opponent is then entitled to claim that the player made an illegal move before he has touched a piece according to Article 4. Only after such a claim the arbiter shall make a ruling.
However, if both Kings are in check or the promotion of a pawn is not completed, the arbiter shall intervene, if possible.
B7. The flag is considered to have fallen when a valid claim to that effect has been made by a player. The arbiter shall refrain from signalling a flag fall.
B8. To claim a win on time, the claimant must stop both clocks and notify the arbiter. For the claim to be successful, the claimant's flag must remain up and his opponent's flag down after the clocks have been stopped.
B9. If both flags have fallen, the game is drawn.

Proposal from Paisley YMCA Chess Club
Replace Rules for League Competitions 12.3 with
Mobile phones must be switched off prior to a match commencement. If a player has a valid reason for having his phone on, such as a work commitment, sick relative, missing team mate, etc then that player must inform BOTH team captains in advance of play starting and the phone must be in silent mode.
Having a phone on without this agreement will result in an extra two minutes being awarded to the opponent for a first offence. A second such offence or a ringing phone will mean automatic loss of the game.
Amend Rules of Play 7.1 to read
Resolve any problems that might occur during the match, including the acceptability of a mobile phone being on, with the opposing match captain.
(Advice to players:
Regardless of the above a player will still lose a game for improper use of mobile technology e.g. gaining advice, running a chess engine, etc.)
Rapid-Play League 2008-09
(The last few seasons have seen a substantial decline in the number of teams entering the Rapid-Play, perhaps in part resulting from changes in dates/ format. The proposal for Season 2009-09 is as follows: )
Structure: 2 Divisions, with at least 6 teams in each
(strongest in Division 1) All-play-all
Rounds: 5-round (minimum), played over three evenings
(Possibly 4 evenings, depending on entries. If large number of
entries, tournament will be run as a “Swiss”).
Dates: Last Wednesday in October, November & January
(Start time: 7:30pm. If 4 evenings, the additional date will be end-Feb)
Venue: Central (to be announced)
Format: 20mins/player. Double round (as at present)
Results: Cross-tables etc will be updated/posted at the venue.

Promotion: One team relegated/promoted - based on game points alone.
The RapidPlay will not go ahead unless a minimum of 12 teams enter
