MUSWELL HILL RUNNERS
DRAFT CONSTITUTION and CLUB RULES
Title
1. The name of the Club is Muswell Hill Runners. ["The Club"].
Colours
2. Vests:- Red shoulders; Black chest band; White body.
Location
3. The headquarters of the Club is at The Hornsey Club, Tivoli Road, Crouch End, London, N8, and/or at other such premises as the Committee from time to time shall deem to be appropriate for that purpose.
Object
4. The object of the Club is the promotion of Amateur Athletics.
Management
5.i) The management of the Club is vested in a Committee consisting of:- The Secretary; The Treasurer; The Membership Secretary; The Female Race Coordinator; The Male Race Coordinator; The League representative; The Cross Country Representative; The Merchandise Representative; The Newsletter Editor; The Social Secretary; The Secretary of the Junior Section; The Coach of the Junior Section. ["the Committee"]
ii) The Committee shall appoint two parents of members of the Junior Section to represent the interests of the Junior Section. The Committee may appoint further members without portfolio as it sees fit.
iii) The Officers of the Committee mentioned in Paragraph 5.1 above shall be elected to office at the Annual General Meeting and will hold office until the next Annual General Meeting, when they are subject to re-election.
iv) The Committee has the power to fill any vacancy which may arise.
v) The Committee shall meet at least once in each quarter.
vi) The quorum for a meeting of the Committee is five.
vii) The Committee has the power to delegate any of its functions, responsibilities and powers to a sub-committee, which the Committee may appoint for any given purpose.
viii) The membership, constitution and powers of any sub-committee is at the absolute discretion of the Committee.
ix) Sub-Committees are to submit reports in writing as to their operation, at such times and giving such details as may be required by the Committee. Members of any sub-committee may also be required to attend at a meeting of the Committee to deliver an oral report.
x) The Honorary President and Founder of the Club is Andrew Marks Esq. The Honorary President and Founder is not a member of the committee unless otherwise elected to a post above.
Membership
6.i) Membership of the Club is confined to Amateurs as defined by the Amateur Athletic Association of England in their 'Rules for Competition' .
ii) Membership of the Club is open to any person. It is the policy of the Club to promote equal opportunities for all people regardless of ability; race; nationality; colour; ethnic or national origins; marital status; gender; sexual orientation; political or religious beliefs. The Club shall not act in any way which is an infringement of a Member's human rights.
iii) An applicant for membership must apply in writing, on a form provided for that purpose, and must agree to be bound by the Constitution and Rules of this Club, and the Rules of the Amateur Athletic Association of England and any other appropriate governing body, insofar as they apply to members of affiliated clubs.
iv) The membership of this Club by any person may be terminated by the Committee if they are satisfied that the member has broken the Rules mentioned in paragraph 6.iii) above; paragraph 11.i) and ii) below, or if they are satisfied that the member's continued membership of the Club is undesirable in the interest of the membership of the Club as a whole.
v) If it is the intention of the Committee to consider the termination of any person's membership they will as soon as practicable appoint a suitable person, not being a member of the Committee, to formulate the appropriate charge or charges.
vi) Any decision by the Committee to terminate a person's membership in accordance with paragraph 6.iv) above requires a majority of two-thirds of the Committee members voting.
vii) Any person whose membership of the Club is terminated by the Committee in accordance with paragraph 6.iv) above has the right to appeal that decision to an Appeals Committee. The Appeals Committee shall consist of one ordinary member of the Club chosen by the appellant, The Secretary of the Club and a suitably qualified independent Chair who is not a member of the Club and who is acceptable to the Appellant. ["The Appeals Committee"].
viii) If at any meeting the Committee proposes to consider the termination of any membership in accordance with paragraph 6.iv) above it shall give the member concerned 14 days notice in writing of the said meeting. The said notice will state the alleged breach of the Club Rules. At any such meeting the member concerned has the right to make representations to the Committee, and to be represented if they so wish.
ix) Any hearing before the Appeals Committee is a complete rehearing of the matter. The Appellant concerned has the right to make representations to the Appeals Committee and be represented if they so wish.
x) Any meeting of the Committee at which the membership of any person is to be discussed, and any hearing of the Appeals Committee, is open to any member of the Club.
Junior Section
7.i) Any person aged between 6 and 17 years may become a member of the Junior Section of the Club.["Muswell Hill Runners Junior Section"]
Resignation
8.i) A member intending to withdraw from the Club shall give notice in writing to The Secretary, and their membership shall terminate on the date of that notice.
Subscription
9.i) The Annual Subscription of the Adult Club shall be determined by the Annual General Meeting, and is payable on joining, and subsequently on the first day of the month following the month during which they joined in each year. There is a reduction of 50% for the unwaged and those in full time education. There is also a reduction determined by the Annual General Meeting, for members who renew their membership within two months of its expiry. Members using the facilities of the Hornsey Club are liable to pay a further additional sum to the Club, entitling the Member to Social Membership of the Hornsey Club. Such additional sum will reflect the agreement between the Hornsey Club and this Club and be approved by the Annual General Meeting.
ii) The Annual Subscription to the Junior Section is payable on joining and subsequently on the 1st October of each year. Such Junior subscription will be determined by the Committee.
iii) The Committee shall have power to expel any member whose subscription is twelve months in arrears provided one month's notice in writing shall have been sent to such member at their last known address, informing them of the proposed action of the Committee.
iv) The name and address of any person expelled in accordance with this paragraph or paragraph 6.iv) above shall be forwarded to the South of England Athletic Association who shall enter their name in a book ("the Suspension Book") to be kept for that purpose. Every person who has been so entered in the Suspension Book shall be suspended from competing at any meeting held under Federation Rules. In the case of non-payment of subscription that person will be suspended until the liability causing their said expulsion, which shall not exceed one year's subscription, shall have been discharged.
v) No member whose subscription is in arrears is eligible to take part in any competition promoted by the Club.
Annual General Meeting
10.i) A General Meeting shall be held annually in the month of June in every year to receive the Committee's report and financial statement, elect Officers and Committee and to deal with any other matter specified on the agenda.
ii) The Secretary must give 21 days notice of the Annual General Meeting, by placing a notice upon the notice board of the Hornsey Club; by ordinary post to each member's last given address; and by having a notice placed in the issue of the Newsletter published last before the date of the meeting.
iii) Notice of any business which it is desired to place on the agenda must be given in writing to The Secretary at least 14 days prior to the meeting.
iv) The quorum for an Annual General Meeting shall be 15% of the paid up Adult membership of the Club.
v) Any paid up adult member of the Club has the right to vote at an Annual or Special General Meeting. Members of the Junior Section do not have the right to vote and cannot form part of the quorum at any meeting.
vi) Motions will be passed by a simple majority. In the event of an equal vote the Chair of the meeting will have casting vote.
vii) A Special General Meeting of the Club must be called by The Secretary within 14 days of the receipt by him/her of a requisition signed by 15% of the paid up membership of the Adult Club. The requisition must state the nature of the business to be brought before the meeting. Notice of a Special General Meeting will be sent by ordinary post to all Members' last given address.
viii) The Committee will appoint a Chair for every Annual and Special General Meeting.
Equality
11.i) No member of the Club shall discriminate against any other member of the Club on the grounds of ability; race; nationality; colour; ethnic or national origins; marital status; gender; sexual orientation; political or religious beliefs or any other grounds that are contrary to human rights; or in any other way.
ii) No member of the Club shall behave in any way which brings the good name of the Club, or the sport of athletics, into disrepute, whether such behaviour comes within paragraph 11.i) above, or otherwise.
iii) Any member whom the Committee consider is in breach of paragraphs 11.i) and ii) above shall fall to be dealt with in accordance with paragraph 6.iv) above.
Finance
12.i) The Treasurer of the Club is responsible for the safe keeping of all Club funds; will keep proper accounts and will present a report to each Annual General Meeting.
ii) Separate accounts shall be kept of the Adult Club and of the Junior Section.
iii) The Committee are empowered to transfer funds from the Adult Club to the Junior Section and vice versa as they consider appropriate.
Alteration of Rules
13.i) No alteration or addition may be made to this Constitution and Rules except by an Annual or Special General Meeting called for that purpose. Notice of any proposed alteration must be given as specified in paragraph 9 above.
ii) This Constitution and Rules may be cited as the Club Rules of Muswell Hill Runners.
